Terms of sale

1) General information

The products featured on the www.idalusparis.com e-commerce site are marketed by IDALUS, S. A. S. CAPITAL 5.000 € - 977 652 064 RCS PARIS - CODE APE 4791B - CODE TVA FR 87977652064. Its e-mail address is idalus.paris@gmail.com

Purchases made via the Internet on the e-commerce site are governed by French law and by the present contractual conditions indicated on the site at the time the order is placed (the "General Conditions"). For any dispute arising from the conclusion, interpretation and execution of a sale made via the IDALUS e-commerce site, the parties acknowledge the exclusive jurisdiction of the French courts.


2) Users and orders

The IDALUS e-commerce site may only be used by end consumers, i.e. natural persons of legal age acting for purposes that do not relate to the commercial, business, artisanal and/or professional activity that may be carried out and who are included in the definition of "consumers" contained in Legislative Decree 206/2005 and subsequent amendments (the "Consumer Code"). Only purchase orders with the following characteristics will be accepted and effective:

- orders shipped to the following countries - for each of which the corresponding price list will be specified - WORLDS

- orders for which it is possible to verify the accuracy of the shipping address and billing information. In such cases, IDALUS reserves the right to terminate the contract with immediate effect by means of a simple written communication by e-mail.


3) Products

The products offered for sale by IDALUS are those shown on the www.idalusparis.com website on the day of consultation by the customer. Each product will be the subject of a description sheet which, in addition to the photograph, will contain: the price, the photograph, the sizes and colors available, the composition, as well as any special characteristics. Minor differences between the product and its photograph may exist, depending in particular on the resolution and color definition of the user's screen.

IDALUS undertakes to supply products that comply with current regulations on personal health and safety, in accordance with European provisions, and in particular with legislation on regulated chemical substances.

 

4) Prices

The purchase prices of IDALUS products will be specific for each country from which the order originates and will be indicated in euros including all taxes, excluding delivery charges and customs duties; it being specified that the value-added tax is that in force for distance selling regulations. Customs charges are payable by the customer.

The prices applied are those communicated on the site and confirmed to the customer when the order is validated.

Delivery costs are communicated to the customer on the order summary before the order is validated, and are inclusive of all taxes. These costs are payable by the customer and are invoiced in addition to the sale price of the products.

IDALUS may apply special promotions to one or more products on the site, which modify the price. We reserve the right to modify our prices at any time, but we undertake to apply the prices indicated on the site at the time of your order.

In the event of an incorrect price being displayed, the order, even if validated, will be cancelled. The customer will be informed as soon as possible.


5) Delivery

The cost of shipping the product, which will be explicitly indicated at the time of purchase, will be borne by the customer. IDALUS undertakes, as the user's agent, to enter into shipping contracts with reputable transport companies, taking into account the conditions applied by the carrier itself. The user:

- may specify that the purchase be shipped to an address different from that of the order and/or billing agent (but always within the same country);

- must indicate a shipping address where he/she will be able to receive the parcel.


Orders will be dispatched within 120 working hours of receipt of payment confirmation. Estimated delivery times depend on the carrier chosen.
Once the order has been dispatched, an e-mail will be sent with all the shipping information the user needs to track the order, including a direct link to the chosen carrier's portal for immediate verification of the delivery status. In any case, IDALUS will not be held responsible for any lack and/or delay in the delivery of the parcel, in the event of non-compliance with the pick-up procedures described above, or in the event of erroneous information being provided by the customer.

- In accordance with article 61 of the French Consumer Code, all orders will be delivered within 30 days of validation of payment. If this is not the case, the customer is invited to contact customer service (idalus.paris@gmail.com).

-Upon delivery of the order, we invite our customers to open the parcel in front of the carrier. If no reservations are made at the time of delivery, IDALUS will not be able to process any claim concerning damage or the absence of an item in the package received, and cannot be held responsible.

For orders outside France, when the parcel intended for export reaches its destination, it is the recipient's responsibility to pay any taxes or customs duties applicable in the destination country. Local authorities can provide useful information.

 

6) Preparation of orders

To conclude the purchase contract, the user-buyer must complete all parts of the order procedure provided on the site and confirm payment for the order in question on the site of the selected payment organization. It is understood that orders from countries other than those indicated and with characteristics other than those specified above (in terms of quantity and place of dispatch) will not be accepted under any circumstances.


7) Drafting procedures and information 

Before validating an order by filling in the order form, it is agreed that the customer is informed of these general terms and conditions of sale, delivery costs (for orders under 200€ for Europe and 300€ for the rest of the world), any information concerning the execution of the contract, the existence of the right of withdrawal and the terms and conditions for returning the product. The general terms and conditions may be archived and/or printed by the user.

 

8) Procedure for drafting and technical information notes

IDALUS will allow the customer/user to access his/her personal data and correct any errors before validating an order.


9) Ordering and information notes

During the ordering process, a series of summary information is provided on product characteristics, price, shipping costs, delivery and payment terms.

10) Order processing and responsibilities

To finalize the purchase contract, you must complete the order and payment procedure on the website of the selected organization. Both operations must be carried out following the instructions provided on the site. If a user does not wish to validate an order by its characteristics, quantities and/or price, he/she should not complete the procedure in question. The user is responsible for correcting the information provided during the ordering and payment procedure. IDALUS declines all responsibility for "unwanted" orders sent in error and/or by minors, and will execute them in accordance with the information provided by the user, being able to claim payment of the established equivalent.


11) Order Confirmation

 The order confirmation and the corresponding data will be archived in the IDALUS telematic database for the period required to dispatch the order and in any case for the period required by law. The customer will receive an order confirmation by e-mail with all the reference data for the order in question. This data will also be visible to registered users in the My Account section. Customers who have placed an order on www.idalusparis.com will be able to print their invoice by logging on to the site in the order space provided for this purpose.

IDALUS reserves the right not to validate orders in the event of :

- Abnormal or abusive complaints,

- abnormal orders with regard to quantities ordered,

- abnormal product prices due to technical problems with the site,

- abnormal or abusive exchanges or returns,

- existing dispute(s) with the customer.


12) Order archiving

The contract is concluded at the latest between the moment IDALUS receives the order confirmation by telematic means and the moment IDALUS receives the payment confirmation from the selected organization, after verification of the correctness of the data, which are reported there. IDALUS has the right to refuse the order, communicating this by e-mail within 120 hours of receipt, in the case of erroneous data or communication of a null and/or erroneous credit card code to the selected organization.

 

13) Unavailability of products

 In the event that the products presented on the IDALUS e-commerce site are no longer available, IDALUS will inform the customer within 30 days of receipt of the order of any unavailability of the products in store. If the price of the product has already been paid, IDALUS will refund the amount paid within 30 days. In this case, IDALUS will not be liable for any damages or other claims.

 

14) Legal warranty

IDALUS guarantees the conformity of the products with respect to what is provided for in the corresponding product sheet on the site for a period of two years and in accordance with articles 128-135 of the French Consumer Code. The warranty does not cover damage caused by: improper treatment of the products, misuse, accidents, water, solvents, wear and tear, damage caused by transporters and, in any case, damage deriving from third-party factors and not attributable to defects in product conformity. Without prejudice to cases of theft or gross negligence, reimbursement is excluded in all cases for damage deriving from product conformity defects and consisting in the loss of the product's contents, as well as damage resulting from the impossibility of using the product.


15) Payment

The price of products purchased is payable in full on the day the order is placed by the customer. Payment for online purchases made on the IDALUS site may be made solely and exclusively by Visa, American Express, Mastercard or Apple Pay credit card.

The amount of the order will be debited from the credit card when the order is validated. The payment of orders takes place outside IDALUS systems, which is therefore in no way the owner or responsible for the processing of bank data or data concerning the credit card, by which the payment in question is made.

In the event of non-payment, incorrect address or any other problem with the customer's account, IDALUS reserves the right to block the customer's order until the problem has been resolved.

In the event of fraudulent use of the customer's credit card on the site, the customer is invited to contact IDALUS by e-mail at the following address: idalus.paris@gmail.com

All information exchanged to process payment is encrypted using SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by a third party. At no time do customer financial data pass through the IDALUS computer system.


16) Right of withdrawal

The customer benefits from a legal right of withdrawal, which may be exercised within 14 days of receipt of the order, in accordance with Articles L. 221-18 and L. 221-20 of the French Consumer Code, if the customer fulfils the conditions laid down in these provisions, without having to justify the decision or pay any penalties.

IDALUS offers the possibility of withdrawing from the contract within 14 days of delivery of the products, without penalty and/or justification. To exercise this right of withdrawal, the purchaser must send an e-mail within this period to idalus.paris@gmail.com

The return of the product must follow the steps indicated in the following returns procedure.


17) Returns procedure

 

The customer is obliged to check the conformity of the products received in shipment of his order at the time of delivery. Any anomaly concerning the delivery, such as: - damaged parcel, - missing products, - deteriorated products, - products not conforming to the order, must be notified within the legal time limit of 14 days following receipt of the order.
This notification will be sent to the customer service department of the IDALUS site either by registered mail, by writing to the following address: IDALUS PARIS 39 RUE SAINT-ANTOINE 75004, PARIS, or by email to idalus.paris@gmail.com.


After the legal deadlines, and except for hidden defects, no claim will be accepted by IDALUS as the products are then deemed to be in conformity.

No returns will be accepted without a duly completed returns form.
Returned products must be packed in the original box (at the purchaser's expense), to prevent the goods from reaching their destination damaged. Only if the original packaging cannot be used, can an equivalent box be used in terms of size and strength. It is not possible to return products following a collection at the expense of the recipient. Once the return has been delivered to the address indicated below, IDALUS will verify the legitimacy of the return. The sums paid at the time of the order will be credited back to the means of payment used. Refunds are normally made within 14 days of receipt of the return.

Please retain the tracking number so that you can follow your return to our premises. On receipt of your return, we will process it within 3 to 15 working days and send you a confirmation e-mail.

The risks and costs of return are the exclusive responsibility of the customer.

In the event of a refund, IDALUS will reimburse all products returned, with the exception of taxes and customs duties paid by the customer at the time of delivery. Cash on delivery returns are not accepted. Upon receipt of a non-conforming item. Products returned other than in their original condition and packaging, notably incomplete, damaged, worn or soiled by the customer, will not be accepted. In the event of abnormal or abusive returns, IDALUS may refuse to serve a subsequent order.

18 ) Personal data

IDALUS collects a certain amount of information required to process orders.

This data is not only necessary for IDALUS to process the customer's order, but also to provide the customer with information on the IDALUS brand, on the site or to enable the customer to benefit from IDALUS commercial offers; if the customer accepts this when validating the order.

This information is strictly confidential and is marked with an asterisk (*) when it is necessary for IDALUS and/or its service providers to manage the customer's order.

IDALUS undertakes to take all necessary precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the customer's personal information from being distorted, damaged or accessed by unauthorized third parties.

 

19) Cookies

 In order to process the customer's order, and in order to better understand the customer's needs and personalize the services offered on the site, IDALUS uses cookies. A cookie is a computer file stored on the hard disk of the customer's computer, the purpose of which is to indicate that the customer has visited the Site.

Cookies memorize the time customers spend on the site, their identity (known thanks to their e-mail address and password) and the contents of their shopping cart. Once disconnected from the site, this information is stored for 30 (thirty) days before being permanently deleted.

 Customers may prevent cookies from being stored by configuring their Internet browser. In this case, the customer loses all personalization of the service offered on the site.


20) Applicable law

These terms and conditions are governed by French law.
